REAL ESTATE SETTLEMENT PROCEDURES ACT: LOAN SERVICING ABUSE REQUIRES QUICK GOVERNMENT INTERVENTION

Reporter Kristi Marohn with the St. Cloud Times wrote an excellent article, "Experts: Improper fees play part in crisis--Servicers may benefit from loans in default" on how some loan servicing companies are engaging in abusive tactics which is helping fuel mortgage defaults across the United States.

The loan servicing companies typically do not own the loans they service and profit margins of just servicing loans is actually fairly small but they can make a tremendous amount of money in tacking on fees and penalties. Loan servicing companies can make even more money if a loan goes into foreclosure because they can charge even more fees.

The ongoing frustration for homeowners, attorneys, and others is that many loan servicing companies are simply none responsive to problems associated with the loans they service. We are seeing fees being charged to consumers for such things as Pre-paid Late Fees for all of 2009, 2010, 2011 or Pre-paid monthly inspection fees for years in advance when there is no inspection even done.

The charging of these fees is a direct cause for an increase in foreclosures across the United States. We are seeing these fees and many other unknown fees being charged now when borrowers enter into loan modification agreements which is why the default rates are so high for those borrowers who have entered into a loan modification only to find themselves stuck again in foreclosure because the fees that were charged forced them into foreclosure once again.

RESPA's Section 6 is routinely ignored by the loan servicing companies as most Qualified Written Requests are either totally ignored or the information they provide is non-information or a letter stating that the law does not require them to give information to the borrower on his/her own loan.

Loan servicing fraud is very prevalent and one must be very diligent when evaluating causes of action. When evaluating a claim please make sure you pull the courthouse records to make sure the signatures of the borrowers are actually the borrowers. We are seeing and hearing of many cases where the loan servicing employees are forging borrowers signatures to documents. These documents often increase the fees so much that it forces homeowners into foreclosure because they can't get anyone on the phone from the loan servicing companies to fix or even address the problems the loan servicer itself caused.

We urge everyone to call your congressman and senator and request they regulate this industry. This is a completely unregulated industry and the abusive behavior is fueling the credit and housing crisis in the United States. Consumers need real protection and relief from those loan servicing companies are preying on the American public.

STERBCOW LAW GROUP MORTGAGE FRAUD RESPA LAWSUIT IN THE NEWS

Reporter Kate Moran of the Times Picayune wrote a terrific article on a lawsuit the Sterbcow Law Group LLC and Melancon Rimes LLC filed on in behalf of their client and plaintiff Sarada LeBourgeois who was the victim of mortgage fraud.

"Lawsuit alleges that a loan originator stole money from a client" was published on May 12, 2009 and briefly describes the events surrounding the lawsuit. The federal case was recently remanded back to Civil District Court in New Orleans by U.S. District Judge Lance Africk.

Kelly McCarel with RESPA News also wrote an excellent article on the case on Feb. 12, 2009 entitled Louisiana case ties RESPA violations to alleged mortgage fraud"

The case was filed in the Orleans Parish, Civild District Court in Louisiana with the docket number 2008-2705 and is listed under the name Sarada LeBourgeois, et al. v. Allied Home Mortgage Capital Corporation, et al.

RESPA: SECTION 9 WHY WAS I REQUIRED TO BUY TITLE INSURANCE FROM SPECIFIC TITLE COMPANY BY SELLER?

The Real Estate Settlement Procedures Act's (RESPA) Section 9 (12 U.S.C. §2608) and Regulation X (§ 3500.16) prohibits, either directly or indirectly, a seller from requiring a purchaser to buy title insurance from a specific title company in any transaction as a condition of the sale.

Section 9 of RESPA (12 U.S.C. §2608) states that:
1. No seller of property that will be purchased with the assistance of a federally related mortgage loan shall require directly or indirectly, as a condition to selling the property, that title insurance covering the property be purchased by the buyer from any particular title company.

2. Any seller who violates the provisions of subsection (a) of this section shall be liable to the buyer in an amount equal to three times all charges made for such title insurance.

The only way a Seller can mandate that purchaser use a particular title company is if the seller paid 100% of all title insurance and related title costs. HUD's RESPA Division has stated on numerous occasions that unless the seller pays 100% of the title related costs then the seller has violated RESPA. REO companies need to pay particular attention to Section 9 because required use practices by REO companies are on the HUD's radar right now.

Additionally there are several local real estate purchase agreements that are in use in parts of the United States where the language in the purchase contract states that Seller picks the title company but purchaser pays for title costs. It should be clearly noted that you can not contract out of a RESPA Section 9 violation. Just because the purchase agreement is signed by the borrower doesn't prohibit the borrower from coming back and suing the seller for required use if the borrower is stuck with any of the title related fees.

Lastly another clever technique that is in use is where the seller says they will pay for the owner's title insurance policy but that purchaser has to pay for the lender's title insurance policy and all other costs. This does not pass the smell test nor does it pass HUD's smell test. The practice while novel in its approach is still considered a Section 9 violation. If you are a borrower has been a victim of this technique within the last year please give our firm a call.

A recent study indicates that the genomic mutation rate of the gut bacterium Escherichia coli is substantially higher in nongrowing than growing cultures. These findings are important in the light of the ongoing controversy over the generality and robustness of stationary phase mutagenesis and its evolutionary implications.

The genomic mutation rate is a fundamental evolutionary parameter of any population, determining the rate of influx of new deleterious and beneficial alleles. Because most mutations are likely to be harmful to fitness, DNA repair and proofreading systems have probably evolved so as to minimize rates of mutation. Even the microbial extremophiles that normally inhabit harsh and potentially mutagenic environments seem to have low genomic mutation rates, suggesting that selection almost always puts a premium on the faithful maintenance and transmission of genetic information. Nonetheless, geneticists have long known that some environmental extremes can elevate mutation rates; indeed, this is the basis for the use of DNA damaging agents to induce mutations for study.

What a sight it was. On December 2, 2006, Midtown Plaza looked like it used to every holiday season. Thousands visited the downtown Rochester, NY retail center. Over 2, 000 people alone attended the annual tuba concert. Various other performances followed that concert while cultural tables were set up around the center. It looked like old times at the beleaguered downtown center.

The plaza has been neglected for years now due to an owner that seems to have little interest in reviving the property. Consequently, events that draw people have disappeared. And, with rumors of possible demolition, it has encouraged disinvestment as businesses have fled. One business owner told me that he struggles to get any sort of information from the current owner; they're not even responsive when asked about lease renewals. The current owner has done virtually no maintenance to the center.

Despite these facts, a core of stores and restaurants have remained. And, their cash registers were singing while some performers in the lobby were doing the same. A Peebles employee told me one employee rung up over $2, 000 in sales in a modest time period. A business owner told me it was the busiest he has seen the center in over eight years. The City of Rochester did a wonderful job with the event, which concluded with the lighting of the Liberty Pole.

What this did was prove the center can be viable. Of course, it'll take significant investment and effort. But, with more and more people living downtown and the Renaissance Square plans, it seems like there's hope for a modest size retail center like Midtown. The City of Rochester may purchase the property. If they do, I hope they'll move as quickly as possible to determine Midtown's fate. That way, if it'll remain, businesses can feel comfortable investing in their location (or new ones) once again. Mixed use space (residential/office) for the office tower sounds interesting, although it won't be inexpensive.

On December 1st, the City of Rochester will host a holiday celebration in Midtown Plaza for the second consecutive year. The event will consist of the annual tuba concert, a second stage for other performers, free monorail rides, and the event will conclude with the lighting of the Liberty Pole. This event was extremely successful last year, and it could be even more successful this year.

The reason it could be is this may be the final holiday season for this historic retail center--the first downtown indoor mall in the country. Earlier this year, it was announced that PAETEC Communications will utilize the site to locate its corporate headquarters. It's wonderful news for the most underutilized section of downtown, even if it's a little sad since it marks the end of Midtown.

The fact the property has been largely abandoned by its current ownership mixed with that announcement has left Midtown as lean as ever in terms of stores. Hopefully its remaining loyal stores like Fauna's Gifts and Peebles will be helped with finding space nearby. The good news for these businesses is the addition of hundreds of new workers should make their stores as viable as ever.

Can you learn to dunk for free?

Obviously, some people can already dunk and just want to increase their vertical. These people are naturally gifted, but I have never met anybody who couldn’t increase their vertical leap. Wether you can dunk or not, if you think you can surf the Internet and read a few articles and pick up a few tips then go out and dunk the basketball or reach your maximum vertical leap, you are seriously mistaken. You will never come close to reaching your potential, let alone dunking the basketball if you are not able to now. You may even injure yourself following the advice of someone that has no business giving athletic training advice in the first place.

There is NO substitute for the advice of a professional

It is impossible to become good at any athletic game without coaching. It doesn’t matter if it is basketball, baseball, football, hockey or any other game you play. You learn how to play by training and practicing under the guidance of a trainer/coach.

Do you think anyone playing professional sports taught themselves? NO! If you are trying to improve your overall game or if you just want to dunk the basketball, YOU NEED TRAINING. If you are rich you can go out and hire a professional trainer. I don’t find that to be a option for 99% percent of the people unless they are a professional athletes. That does not mean you can’t get a training program from a professional trainer that can teach you exactly what to do and how to do it. There is a lot more involved than just doing some exercises.

Are you a Contender or a Pretender? 

The only difference between people that can dunk the basketball and those who can’t is, those who can dunk took action and started doing the right training needed to dunk. What’s stopping you?

Right now you are just a few minutes away from actually doing something about your inability to dunk the basketball. You can be the one flying through the air and dunking, striking fear in your competition. There is no better feeling on the court than disrespecting your opponets with a vicious dunk in their face. Or you can be a dreamer watching others be the star.

You will never dunk a basketball if you don’t start training. You could start training today. What are you waiting for? The sooner you start the sooner you will be amazing everyone with your high flying dunks.

The Resurgence of the Rochester Rhinos and PAETEC Park?
The Rochester Sport Group's financial issues have been a popular story here in Rochester. Due to a $10 million loan that the ownership team took on for PAETEC Park, they've found themselves overleveraged. That issue caused the organization to fall behind on its obligations which ultimately put the 2008 soccer season in jeopardy. Thankfully, an individual tied to one of the banks that provided the loan, Rob Clark, had an interest in running a sports team and decided to purchase the team and stadium.

This is exciting for two reasons. First off, the team has been plagued by a lack of marketing thanks to a cash-poor organization. Suddenly, that burden has been removed. Within the first week, the new owner fired an unpopular coach, signed a popular former player to coach the team, signed an international player to also assistant coach, and began working to replace a food vendor that many complained about with a local vendor. Even further, $4 million in state funding to complete the stadium was being held up due to the team's financial issues. That's being released and the stadium will be "completed" for 2009.

This has led to a surge in season ticket sales. They're already above 3, 000, so they should top last year's number despite the majority of the off-season being mired in controversy. And, perhaps more importantly, the stadium will be finished, which will give it the opportunity to live up to its full potential. There's a buzz about the Rochester Rhinos and soccer in general again, and that's certainly a breath of fresh air.

RIT Hockey Defeats Cornell 4-1

Congrats to the Tigers for beating #18 Cornell 4-1. RIT played the game at the Blue Cross Arena in downtown Rochester, and a program record 5, 142 fans attended--with 80% or so cheering for RIT. The Tigers dominated in special teams play with two power play goals and seven successful penalty kills, and that was the difference. Ultimately, it was a defining moment for this third-year Division 1 program: a lot of people got exposed to the team for the first time locally and it made a statement nationally.

Razorsharks Bolt from the ABA
The Rochester Razorsharks opted to withdraw from the American Basketball Association playoffs--several other teams also opted out of the playoffs--and focus on a new league that they'll join next year called the Premiere Basketball League. Now, the obvious question becomes why did they opt to do this? It's quite the story. The final straw involved a planned playoff date that had been canceled because the opposing team's coaches couldn't get to Rochester because of travel delays tied to a storm. That's fair enough, although it could have been prevented had they not been forced to toss together travel plans at the last second because the previous round game was 40 hours earlier. The Blue Cross Arena was booked the following week because of the NCAA Hockey Regionals. The league was unhappy with the delay, so they tried to force them to move to another venue. Now, the Razorsharks average over 4, 000 fans, while many of the league's teams play in front of a couple hundred family members and friends in a local high school gym. So the fact they had season ticket holders and sponsorship obligations seemed to be foreign to the league. Rochester had nailed down a date the following week and informed the league. Then a couple hours later the league's CEO e-mailed out to the other owners requesting opinions as to whether Razorsharks should be forced to forfeit. Needless to say, they opted to leave before any sort of consensus could be determined based on their opponents' opinions.

Now, this was just the last event in what has really been a comical experience for a team that clearly operates at a much higher level than most of the league. Their last home loss--about a year and a half ago--was to a team that was out of cash. Consequently, the Razorsharks paid their travel costs so the game could be played and that was their final game. Rochester hosted the "Great Eight" last season with the league. However, there are rumors of the league not living up to reimbursement promises despite the event drawing well. Southern California left the league partially because the league never reimbursed them. This year, the Toledo Royal Knights--the second team in Toledo this season--didn't bother to communicate with Rochester at all regarding a road game, nor would they respond to calls. Consequently, the league's president--an individual who tried to arrange a hostile takeover of the ABA because of his frustration with the league's poor leadership--told them not to bother traveling that day. Toledo proceeded to fold. Then Rochester opted not to travel to a road game in Brooklyn--which was the second team in Brooklyn this season--due to the accommodations they arranged. As it turns out, the motel has a storied past including prostitution and a murder.

Ultimately, the league is completely dysfunctional. Less than half of the teams survive from season to season. Generally, all of the successful ones bail within two years. The CBA took a couple teams last year, the NBA's D-League has one, and it appears a number of teams will bolt to this new league next year. Whether the intentions with expansion are good or not, I don't know. The idea of a league with tons of teams so travel is modest makes sense. But so many of the teams are so amazingly undercapitalized that it seems the league is happy to take their $10, 000 or so in expansion fees and watch the inevitable collapse--there are no enforced standards. That has ultimately led to this league being seen negatively, or as a "total farce" and the "Always Bad Association" as a local columnist put it. There are some good teams, but they are all dragged down by the bad apples. Rochester's future will be much brighter in this new league, as will the futures of the other teams that opt to leave the ABA.

Volunteering in Rochester
This past Friday, I had the privilege of visiting a third grade class at School #41 in Rochester. It was the most rewarding volunteering experience I have ever been a part of. It was put on by Junior Achievement in cooperation with RIT's Saunders College of Business. The program allows individuals from the community to go in and teach a class for a day. If you get a chance to get involved with this program, I highly recommend that you do so.

Additionally, Rochester Cares is a great local organization with a wide array of activities. The City of Rochester School District has additional opportunities. So for those that are looking to get involved in Rochester, there are a number of great ways to do so. My experiences in the Rochester City School District have been very positive. While challenges exist, it's definitely not the picture that many stereotype it to be. I recommend that you get involved and see for yourself.

Now is the time for you to ask yourself the tough questions. Are you serious about increasing your vertical leap? Are you willing to do the work needed to perform amazing dunks that leave your friends cheering for you,  well striking fear in your competition?

Can you learn to dunk for free?

Obviously, some people can already dunk and just want to increase their vertical. These people are naturally gifted, but I have never met anybody who couldn’t increase their vertical leap. Wether you can dunk or not, if you think you can surf the Internet and read a few articles and pick up a few tips then go out and dunk the basketball or reach your maximum vertical leap, you are seriously mistaken. You will never come close to reaching your potential, let alone dunking the basketball if you are not able to now. You may even injure yourself following the advice of someone that has no business giving athletic training advice in the first place.

There is NO substitute for the advice of a professional

It is impossible to become good at any athletic game without coaching. It doesn’t matter if it is basketball, baseball, football, hockey or any other game you play. You learn how to play by training and practicing under the guidance of a trainer/coach.

Do you think anyone playing professional sports taught themselves? NO! If you are trying to improve your overall game or if you just want to dunk the basketball, YOU NEED TRAINING. If you are rich you can go out and hire a professional trainer. I don’t find that to be a option for 99% percent of the people unless they are a professional athletes. That does not mean you can’t get a training program from a professional trainer that can teach you exactly what to do and how to do it. There is a lot more involved than just doing some exercises.

Are you a Contender or a Pretender? 

The only difference between people that can dunk the basketball and those who can’t is, those who can dunk took action and started doing the right training needed to dunk. What’s stopping you?

Right now you are just a few minutes away from actually doing something about your inability to dunk the basketball. You can be the one flying through the air and dunking, striking fear in your competition. There is no better feeling on the court than disrespecting your opponets with a vicious dunk in their face. Or you can be a dreamer watching others be the star.

You will never dunk a basketball if you don’t start training. You could start training today. What are you waiting for? The sooner you start the sooner you will be amazing everyone with your high flying dunks.

Fiscal Responsibility and the GOP?
On election eve, along with the social security advertisements the GOP is running locally, the party is also talking about candidates who might vote for (or have voted for) tax increases. Of course, they forget to point out who is responsible for driving up governmental spending of late. Tax cuts mixed with spending increases are fiscally irresponsible. It's quite a change for a party that used to be considered fiscally conservative.

I am happy the advertisements will end. And, here in Rochester, GOP-sponsored "doom and gloom" advertisements seem to be outnumbering those by the Democrats. They're even branding a candidate as an out-of-touch millionaire (how much, exactly, is in the bank accounts of Bush and Cheney?). It has been another entertaining round of election tactics. But, again, I'm ready for them to end. If we could only end advertising and replace the advertisements with debates....

Palin's honeymoon ends
Republican Chuck Hagel provided a scathing--but valid--commentary on Palin when it comes to foreign policy:

"She doesn't have any foreign policy credentials. ... You get a passport for the first time in your life last year? I mean, I don't know what you can say. You can't say anything."

"It's a stretch to, in any way, to say that she's got the experience to be president of the United States."

Palin's performance during the Gibson interview, particularly on the topic of foreign policy, was quite weak. At one point, she attempted to change the topic to energy policy in a desperate effort to avoid discussing a weakness and hit a talking point.

Not surprisingly, the honeymoon period seems to be over for Palin. Her positive ratings are down and her negative ratings are up. The Gibson interview revealed her weaknesses. She remains a good pick (for McCain) as it has clearly invigorated McCain's campaign, but with that and the polls showing Obama regaining the lead, the honeymoon is over. With the economic troubles, the focus returns to topics of substance.

Ouch! A little in-fighting among the McCain campaign. Of course, they find themselves down in the polls, and are resorting to the politics of fear instead of discussing the issues. But, unfortunately, such tactics that involve smears (and in many cases lies) can be effective, so I think counting them out is a mistake. I expect it to be close, but problems like this and Obama's fundraising edge puts him in a favorable position. It'll be an interesting final week and change.

An All New York Presidential Race?
As I read this article about Michael Bloomberg leaving the GOP and potentially entering the presidential race as an independent, it got me thinking about the possibility that the three leading nominees (Republican, Democrat, and Independent) for president in 2008 could have received their most recent political experience in New York. Democratic front-runner Hillary Clinton is one of New York's representatives in the United States Senate, Rudy Giuliani is New York City's previous mayor, and Bloomberg is New York City's current mayor. While I haven't looked into it, I have to believe that would be a first. 

Of course, Clinton and Giuliani have lots of work ahead of them. Clinton still holds a solid lead and I expect her to emerge, but I think Barack Obama is a strong candidate too. Giuliani might be a bit "too liberal" to get through the GOP's primaries, although he still holds a narrow lead according to most polls. Thompson, a long-time lobbyist, seems to be gaining ground. I'd be a little surprised if Rudy survives the smear tactics that are sure to occur to him due to his beliefs on gun control and abortion.

Signs of Desperation from McCain?
It's early, but McCain is trailing by a decent margin. If I were him, I wouldn't be terribly concerned yet, but it looks like he's getting a little desperate:

Many of the proposed solutions, such as offshore drilling, wouldn't impact prices for years anyway. It seems like a band-aid to a serious problem that'll only have a modest long-term effect on prices to me.

Oh well, if Obama gets desperate, he can claim that McCain hates the environment. I used to like McCain, but over the past four years he's become quite the flip flopper. I like politicians that are open to reason and may change their stance on issues based on a solid presentation of evidence, but I have less respect for people that change their stance on issues purely because of party pressure...
